Former Grand Rapids Police Officer Christopher Schurr will have his case considered by the Michigan Court of Appeals

GRAND RAPIDS, Mich. — The Michigan Court of Appeals set a date for oral arguments in the case against former Grand Rapids police officer Christopher Schurr. 

It was back in April 2022, that Officer Schurr fatally shot Patrick Lyoya during a traffic stop.  

Schurr is charged with second-degree murder. He is expected to appear in court on Wednesday, Sept. 6. 

Schurr’s defense attorney, Matt Borgula, has asked the judge to dismiss the charges, arguing that officer Schurr's actions were justified based on:  self-defense, force in response to force used by person being arrested, and the fleeing felon rule. 

A Kent County judge has ordered that Schurr stand trial, which is scheduled for Oct. 24.
