Chris Schurr, 31, of Grandville, is charged with second-degree murder for the death of Patrick Lyoya.
(GRAND RAPIDS, Mich.) - There were two days of a preliminary hearing last week in Grand Rapids.
The court heard testimony from a number of people and the judge took the weekend to look over the information and release a decision this morning.
The officer, Christopher Schurr, who fatally shot Patrick Lyoya during a traffic stop in Grand Rapids , is being charged with second-degree murder.
Judge Nicholas Ayoub said that ultimately, a jury must decide.
In question is whether the incident constituted murder and if the shooting was in self-defense.
Patrick Lyoya was pulled over during a traffic stop back in April and he attempted to run away and eventually struggled with Officer Schurr and grabbed his taser.
There is a possibility that an appeal would likely delay a trial.
